Terms and Conditions for Remote Online Notarization Services with Notary Service Nearby LLC
Effective Date: August 1, 2025

1. Acceptance of Terms By accessing or using our website and Remote Online Notarization (“RON”) services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Service Overview Our company provides remote online notarization services in compliance with the laws of the State of Ohio, including Ohio Revised Code Chapter 147 and Ohio Administrative Code Chapter 111:6-1.

3. Third Party Payment Processors
All Remote Online Notarization (RON) services provided by Notary Service Nearby LLC are billed at a rate of $5 per notarial act (e.g., jurat, acknowledgment), plus a $10 technology fee per session. Fees are assessed per notarial act, not per signature.
Accepted Payment Methods
Notary Service Nearby LLC uses trusted third-party payment processors, including but not limited to Apple Pay, Google Pay, Visa, MasterCard, American Express, and Discover, to securely process your payments. All payments must be submitted in full through our secure website prior to the scheduled notarial session. Services will not be rendered unless payment is received and confirmed.
By using our services, you acknowledge and agree that:

Your payment and personal information may be collected, processed, stored, or shared by these third-party platforms according to their own privacy policies and terms of service.

Notary Service Nearby LLC does not control and is not responsible for the data collection, security practices, or usage policies of these third-party providers.

It is your responsibility to review the privacy policies and terms of use of any third-party payment system you choose to use.

Notary Service Nearby LLC disclaims any liability for loss, theft, unauthorized use, disclosure, or misuse of your information by any third-party payment processor.
By completing a transaction through our website or services, you agree to release, indemnify, and hold harmless Notary Service Nearby LLC and its representatives from any claims, damages, or liability arising out of or related to your use of third-party payment services.

4. Refund Policy

If you cancel more than 24 hours before your scheduled session, you may be eligible for a full refund, issued at the discretion of Notary Service Nearby LLC.

If you cancel within 24 hours of your scheduled session or fail to attend the session, no refund will be issued unless a verified emergency or extenuating circumstance is presented.

5. Non-Refundable Technology Fee
A $10 non-refundable technology fee is charged for all scheduled Remote Online Notarization (RON) appointments. By booking an appointment, the client acknowledges and agrees to the following conditions under which this fee will not be refunded:

Late Cancellation: If the client cancels the appointment with less than 24 hours’ notice, the $10 technology fee will be retained and is non-refundable.

Client-Side Technical Issues: If the appointment cannot proceed due to technical difficulties on the part of the client—including but not limited to inadequate internet connectivity, inability to access the RON platform, or failure to operate necessary technology—the $10 fee will not be refunded.

Identity Verification Failure: If the notarial act is not completed due to the client’s failure to provide sufficient proof of identity, including unsuccessful completion of the Knowledge-Based Authentication (KBA) process, invalid or unacceptable identification documents, or at the notary’s sole discretion regarding the adequacy of the identification presented, the $10 technology fee remains non-refundable.
By proceeding with the scheduling of a remote notarization, the client further agrees not to dispute or initiate a chargeback with their credit card issuer or financial institution regarding the non-refundable $10 technology fee, having acknowledged these terms at the time of booking.

6. Identity Proofing Protocols To comply with Ohio RON requirements, we utilize multi-factor authentication including: - Credential Analysis: Analysis of a government-issued photo ID for authenticity. - Knowledge-Based Authentication (KBA): A minimum of five questions based on the signer’s public record data, with an 80% pass requirement within two attempts.
Failure to pass the identity verification process will result in denial of notarization services. Furthermore, if the required identification (US driver’s license or US passport) is presented and the Knowledge-Based Authentication is successful, the notary reserves the right to deny notarization based on her own discretion. If the notary denies notarization for any reason after the notarization session has started, the $10 technology fee will not be refunded.
By proceeding with the scheduling of a remote notarization, the client further agrees not to dispute or initiate a chargeback with their credit card issuer or financial institution regarding the non-refundable $10 technology fee, having acknowledged these terms at the time of booking.

7. Client Accounts, Communications and Email Consent
Client Accounts
Clients may choose to create an account with Notary Service Nearby LLC for easier scheduling, faster checkout, access to service history, and exclusive updates. Creating an account is optional and not required to use our notarization services. Clients are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
Email Communications and Newsletter Subscription
By using this site or booking a service, you may be offered the option to subscribe to our email newsletter. This newsletter may include updates about our services, educational content related to notarization, and occasional promotional offers. Subscribing is entirely optional and requires your affirmative consent (opt-in).
By subscribing, you agree to receive email communications from Notary Service Nearby LLC. Your email address will never be sold or shared with third parties for marketing purposes.
Unsubscribing and Withdrawing Consent
You may unsubscribe from our newsletter or withdraw your consent to receive marketing emails at any time by clicking the “unsubscribe” link found at the bottom of any email, or by contacting us directly at information@notaryservicenearby.com with your request.
Please note that withdrawing from marketing communications will not affect transactional emails related to notarizations, receipts, appointment confirmations, or legal notifications, which you may still receive as part of your use of our services.
Termination of Services by Client
Clients may terminate their use of services provided by Notary Service Nearby LLC at any time by providing written notice via email to information@notaryservicenearby.com or by using any available cancellation feature provided on our website or booking platform.

Termination requests must be submitted at least 24 hours prior to any scheduled appointment in order to be eligible for a refund, subject to the terms outlined in our Payments and Refunds section.

Once a notarial session has begun or a notarial act has been completed, no cancellation or refund will be available.

Termination of service does not release the client from the obligation to pay for services already rendered.
Effect of Termination
Upon termination, the client’s access to any scheduled services or sessions will be canceled, and any data or documents submitted to Notary Service Nearby LLC will be handled in accordance with our Privacy Policy and applicable recordkeeping laws.
We reserve the right to retain certain transaction records or communications for compliance, audit, or legal purposes, even after termination of service.

8. Electronic Consent, Disclosure and Liability Waiver - By using our services, you consent to: - The use of electronic records and signatures. - Audio-video recording of the entire notarization session. In accordance with Ohio law, all remote online notarizations are electronically recorded and retained in a secure, encrypted format for a minimum of ten (10) years. These audiovisual records, along with electronic journals, are maintained solely for legal and regulatory compliance. By scheduling and participating in a remote notarization session, the client expressly consents to the full audio-video recording of the session understand that these records may be disclosed as required by law, court order, or request from the Ohio Secretary of State or other authorized authorities. You may withdraw consent by discontinuing use of the service. Withdrawal does not affect prior transactions. In the event of technical failures (e.g., internet issues, system errors, platform downtime). Notary Service Nearby LLC shall not be liable for any delay or failure to perform its obligations due to causes beyond its reasonable control, including but not limited to acts of God, internet or power outages, platform service interruptions, cyberattacks, governmental actions, or pandemics.

9. Notarial Disclaimer and Liability Waiver –
No Guarantee of Legal Effect or Enforceability: The notary is not an attorney and cannot provide legal advice or ensure the legal effectiveness, completeness, or accuracy of any document presented for notarization. The notary’s role is limited to identity verification and execution of the notarial act. – We are not responsible for the legal sufficiency, accuracy, or completeness of the documents that we notarize. - While all reasonable steps are taken to verify identity and ensure lawful notarizations, Notary Service Nearby LLC, its notaries, agents, and representatives shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of its services, including but not limited to lost profits, data loss, or legal disputes resulting from the content of the documents presented for notarization. By using our services, the client acknowledges that the notary is not an attorney and cannot provide legal advice or determine the legal sufficiency of any document.
Client’s Responsibility for Document Content and Accuracy: The client is solely responsible for ensuring that all documents are complete, accurate, and properly prepared prior to the notarial act. The notary is not responsible for detecting errors, omissions, false statements, or fraudulent content within any document. The notary does not and cannot provide legal advice or verify the truthfulness of the contents within any document. The client acknowledges that notarization confirms the identity of the signer and the act of signing, not the validity or enforceability of the document itself.
Identification and Credential Review: While reasonable efforts will be made to verify signer identity in compliance with Ohio RON laws, Notary Service Nearby LLC is not liable for forgeries, misidentifications, or the misuse of personally identifying information provided by the client or signer.
No Liability for Rejected Documents: Notary Service Nearby LLC shall not be held liable if a notarized document is rejected by a third party, institution, court, or government entity. The client is responsible for confirming document requirements prior to scheduling notarization.
Limitation of Liability: To the fullest extent permitted by law, the total liability of Notary Service Nearby LLC for any claim, loss, or cause of action arising out of or relating to its services shall not exceed the total fees paid for the specific notarial act giving rise to the claim. Under no circumstances shall Notary Service Nearby LLC be liable for incidental, consequential, indirect, or punitive damages.

10. Indemnification -
To the fullest extent permitted by law, by using the services of Notary Service Nearby LLC, the client (referred to as “You” or “Client”) agrees to indemnify, defend, and hold harmless Notary Service Nearby LLC, its owner(s), notaries, employees, contractors, affiliates, agents, representatives, successors, and assigns (collectively, “the Company”) from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees and legal costs), arising out of or resulting from:
Client Misrepresentation or Misuse:
Any false, misleading, or fraudulent information, documents, or identification provided by the Client or any signer involved in the notarization process.
Unauthorized or Unlawful Use:
Any misuse or unlawful use of a notarized document after the notarial act is completed, including but not limited to tampering, alterations, or submission for illegal purposes.
Violation of Law or Third-Party Rights:
Any claim that the notarized documents infringe upon or violate the rights of another party, including privacy rights, contractual rights, or any applicable law or regulation.
Improper Execution or Preparation by Client:
Any legal or financial consequences arising from the improper drafting, execution, or use of the documents by the Client or any third party not under the control of Notary Service Nearby LLC.
Failure to Meet Third-Party Requirements:
Rejection of notarized documents by government agencies, financial institutions, courts, or any third party due to factors outside the Company’s control, including form errors, policy changes, or specific format requirements not disclosed at the time of service.
Technical Failures or Platform Issues:
Any interruptions, delays, or data losses resulting from internet outages, third-party platform failures, or user-side technology problems, provided that the Company has exercised reasonable diligence in facilitating the remote online notarization.
The Client’s obligation to indemnify the Company shall survive the completion of services and remain in effect regardless of the outcome or disposition of any claims or legal actions.

11. Dispute Resolution and Arbitration Agreement In the event of any dispute, claim, or controversy arising out of or related to the services provided by Notary Service Nearby LLC, or the interpretation, enforcement, or breach of these Terms and Conditions (a "Dispute"), the following resolution process shall apply:

Before initiating any legal proceeding, both parties agree to attempt to resolve the Dispute through good faith informal negotiations. Either party may initiate this process by providing written notice to the other party describing the nature of the Dispute and the relief sought. The parties shall use their best efforts to resolve the matter within fifteen (15) business days of such notice. If the Dispute is not resolved informally within that time frame, the parties agree to proceed to mediation.
2. If informal discussions do not resolve the Dispute, the parties agree to submit the matter to non-binding mediation in Greene County, Ohio, or virtually if both parties consent. The mediation shall be administered by a mutually agreed-upon mediator or, if the parties cannot agree, by a mediator appointed through the American Arbitration Association (AAA) under its Mediation Procedures. Each party shall bear its own costs and shall share the mediator's fees equally, unless otherwise agreed in writing
3. Initial Resolution Through Small Claims Court
The parties agree that any Dispute must first be brought in the Small Claims Division of the Fairborn Municipal Court, located in Greene County, Ohio, provided the claim qualifies under the court’s jurisdictional limits. Only if the Dispute cannot be resolved within the jurisdiction of this court, or exceeds the applicable monetary threshold, shall the matter proceed to arbitration as described below.
4. Binding Arbitration (If Necessary)
If a Dispute is not resolved through small claims court, it shall be exclusively and finally resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are incorporated herein by reference and available at www.adr.org.
The arbitration shall be conducted by a single arbitrator selected in accordance with those rules. Unless otherwise agreed, arbitration will be held in Greene County, Ohio, or conducted virtually at the discretion of the arbitrator and the parties. Judgment on the award rendered may be entered in any court having jurisdiction in the State of Ohio.

Limitation on Claims and Damages
To the fullest extent permitted by applicable law, you agree that any claim or damages sought shall be limited to the total amount paid for the specific notarial service in question. You expressly waive any right to seek indirect, incidental, consequential, punitive, or special damages.

Class Action Waiver
All claims must be brought on an individual basis only. You and Notary Service Nearby LLC agree that neither party shall bring any Dispute as part of a class action, class arbitration, or representative proceeding. The arbitrator shall not have the authority to hear or arbitrate any class or collective claims.

12. Governing Law These Terms and Conditions, as well as any dispute, claim, or controversy arising out of or relating to the services provided by Notary Service Nearby LLC, shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
By using our services, you agree that any legal matters not resolved through small claims court or arbitration, as outlined above, shall be brought exclusively in a court of competent jurisdiction located in Greene County, Ohio, and you consent to the personal jurisdiction of such courts.

13. Intellectual Property All content, branding, and materials associated with Notary Service Nearby LLC, including but not limited to the company name, logo, slogans, business methods, processes, and any proprietary information (collectively, the “Intellectual Property”), are the exclusive property of Notary Service Nearby LLC, and are protected under common law rights and applicable intellectual property laws, even if not formally registered.
Unauthorized use, reproduction, distribution, or imitation of any aspect of the Intellectual Property is strictly prohibited. The recipient of this document, client, partner, or any third party agrees not to copy, replicate, reverse-engineer, or utilize any of Notary Service Nearby LLC’s Intellectual Property without prior written permission.
Notary Service Nearby LLC reserves all rights to pursue legal remedies in the event of unauthorized use or infringement of its Intellectual Property.
This clause shall survive the termination of any agreement or relationship between the parties and shall remain in full effect indefinitely.

14. Termination by Notary Service Nearby LLC Notary Service Nearby LLC reserves the right to suspend or terminate a client’s access to services, scheduled appointments, or account at any time and without prior notice if, in our sole discretion, we determine that the client has:

Violated any part of these Terms and Conditions;

Engaged in fraud, attempted fraud, or misrepresentation;

Abused or misused our services, systems, staff, or platforms;

Provided false identification, documentation, or information;

Acted in a manner that compromises the security, legality, or integrity of our services or other clients’ experiences.
In the event of such termination, the client may be denied access to future services and may not be entitled to a refund. Notary Service Nearby LLC also reserves the right to pursue legal remedies or report fraudulent activity to the appropriate authorities.

15. No Waiver of Rights Failure by Notary Service Nearby LLC to enforce any part of these Terms and Conditions shall not be construed as a waiver of our right to enforce that or any other provision at a later time.
Our decision not to exercise or enforce any right, term, or provision—whether on a one-time or repeated basis—does not constitute a waiver of such right or provision. All rights and remedies under these Terms and Conditions remain in full force and effect unless expressly waived in writing by an authorized representative of Notary Service Nearby LLC.

16. Modifications We reserve the right to modify these Terms and Conditions at any time. Continued use of our services constitutes acceptance of any changes.

17. Severability If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the Terms and Conditions and shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
